Diagnostic self-testing devices are being developed for many illnesses, chronic diseases and infections. These will be used in hospitals, at point-of-care facilities and at home. Designed to allow earlier detection of diseases, self-testing diagnostic devices may improve disease prevention, slow the progression of disease and facilitate better treatment outcomes. These devices have the potential to benefit both the individual and society by enabling individuals to take a more proactive role in the maintenance of their health and by helping society improve (...) health and reduce health costs. However, the full implications of future home-based diagnostic technology for individuals and society remain unclear due to their novelty. We argue that the development of diagnostic tools, especially for home use, will heighten a number of ethical challenges. This paper will explore some of the ethical implications of home-based self-testing diagnostic devices for the autonomous and relational dimensions of the person. This will be facilitated by examining the impact of diagnostic devices for individual autonomy, for the delivery of accurate diagnosis and for the personal significance of the information for the user. The latter will be examined using Charles Taylor's view of personhood and his emphasis on human agency and interpretation. While the ethical issues are not necessarily new, the development of home-based self-testing diagnostic devices will make issues regarding autonomy, accuracy of information and personal significance more and more demanding. This will be the case particularly when an individual's autonomous choices come into conflict with the person's relational responsibilities. (shrink)

This paper aims to critique the phenomenon of advanced patient autonomy and choice in healthcare within the specific context of self-testing devices. A growing number of self-testing medical devices are currently available for home use. The premise underpinning many of these devices is that they assist individuals to be more autonomous in the assessment and management of their health. Increased patient autonomy is assumed to be a good thing. We take issue with this assumption and argue that self-testing provides a (...) specific example how increased patient autonomy and choice within healthcare might not best serve the patient population. We propose that current interpretations of autonomy in healthcare are based on negative accounts of liberty to the detriment of a more relational understanding. We also propose that Kantian philosophy is often applied to the healthcare arena in an inappropriate manner. We draw on the philosophical literature and examples from the self-testing process to support these claims. We conclude by offering an alternative account of autonomy based on the interrelated concepts of relationality, care and responsibility. (shrink)

This paper argues that professionals who make boundary-related decisions should be guided by relationship-based practice. In our roles as service users and professionals, drawing from our lived experiences of professional relationships, we argue we need to move away from distance-based practice. This includes understanding the boundary stories and narratives that exist for all of us – including the people we support, other professionals, as well as the organisations and systems within which we work. When we are dealing with professional boundary (...) issues, we should centre relationship-building skills that are central to many other aspects of our work. Skills that foster relationships at all levels – between professionals, service users, and services – need to be revalued. Our final recommendation is to create, develop, and foster safer spaces within and outside of organisations, as well as inter-professionally, for the discussion and exploration of boundary-related issues and practice. We are interested in hearing from those with experiences of being marginalised by boundaries so that they can inform a reshaping of our collective ideas around boundary related practices. To foster relationship-based practices in organisations, we have outlined several recommendations here; however, we recognize that these do not go far enough, and that collective action is needed to inform systemic change. Her notion of the proxy, which raises questions too about the binding force of the speech act through the identity and tactics of the speaker, is especially apt in describing exactly what Rosalind does. Understandably Rosalind's performative manqué may be a prelude to the perfected form. Another complication suggests itself if one is going to attend to niceties of language usage: given that for Austin a performative procedure is founded on conventions of language, shouldn't one also examine such linguistic forms historically? Psychiatry is rapidly adopting digital phenotyping and artificial intelligence/machine learning tools to study mental illness based on tracking participants’ locations, online activity, phone and text message usage, heart rate, sleep, physical activity, and more. Existing ethical frameworks for return of individual research results (IRRs) are inadequate to guide researchers for when, if, and how to return this unprecedented number of potentially sensitive results about each participant’s real-world behavior. To address this gap, we convened an interdisciplinary expert working group, supported by (...) a National Institute of Mental Health grant. Building on established guidelines and the emerging norm of returning results in participant-centered research, we present a novel framework specific to the ethical, legal, and social implications of returning IRRs in digital phenotyping research. Our framework offers researchers, clinicians, and Institutional Review Boards (IRBs) urgently needed guidance, and the principles developed here in the context of psychiatry will be readily adaptable to other therapeutic areas. Proponents of the dominant contemporary model of corporate governance maintain that the shareholder is the primary constituent of the firm. The responsibility for managerial decision makers in this governance system is to maximize shareholder wealth. Neoclassical economists ethically justify this objective with their interpretation of Adam Smith's notion of the Invisible Hand. Using a famous quotation from The Wealth of Nations, they interpret the Invisible Hand as Smith's (An Inquiry into the Nature and Causes of the Wealth of Nations, Methuen (...) & Co., London) assertion that market participants, in pursuing their own self-interests without regard to the interests of others, will collectively provide the optimal economic benefit to society. We argue that the traditional interpretation of Smith is too narrow and potentially harmful to society. In order to fully understand Smith's notion of the influence of the Invisible Hand on human behavior, one must also consider The Theory of Moral Sentiments. In that work, Smith (The Theory of Moral Sentiments, A. Millar, London) portrays the pursuit of self-interest as only one of several potential motivations for human action. He also acknowledged the existence of a “sympathy principle,” which refers to the ability and propensity of human beings to consider the interests of others. Heilbroner (The Essential Adam Smith, W.W. Norton, New York, p. 59) suggests that Smith's sympathy principle allows one to “determine the appropriate degree of self-interest, the proper display of benevolence, the desirable strictness of justice.” In fact, Smith indicates that (1) a society whose members pursue self-interest without a sense of justice will eventually collapse; (2) a society whose members pursue self-interest checked by their sense of justice alone will survive; (3) a society whose members pursue self-interest, justice, and the interests of others will flourish. Since a more complete reading of Smith indicates that human beings, in considering their own interests, also reflexively consider the interests of others when making decisions, then the traditional corporate governance model appears to be lacking. A broader, multiple stakeholder approach to corporate governance that considers the interests of other constituencies may be more consistent with Smith's views. In particular, Smith's sympathy principle provides a theoretical foundation for a shift away from the narrow, yet dominant, shareholder-based corporate governance model and toward multiple stakeholder models of corporate governance [e.g., Business and Society: A Strategic Approach to Corporate Citizenship, Houghton Mifflin, Boston, MA] and internal decision-making [e.g., Sloan Management Review 38, (1997) 25–37]. Jaswal & Akhtar provide several quotes ostensibly from people with autism but obtained via the discredited techniques of Facilitated Communication and the Rapid Prompting Method, and they do not acknowledge the use of these techniques. As a result, their argument is substantially less convincing than they assert, and the article lacks transparency.

The aim was to synthesize the findings of empirical research about the unmet nursing care needs of older people, mainly from their point of view, from all settings, focusing on (1) methodological approaches, (2) relevant concepts and terminology and (3) type, nature and ethical issues raised in the investigations. A scoping review after Arksey and O’Malley. Two electronic databases, MEDLINE/PubMed and CINAHL (from earliest to December 2019) were used. Systematic search protocol was developed using several terms for unmet care needs (...) and missed care. Using a three-step retrieval process, peer-reviewed, empirical studies concerning the unmet care needs of older people in care settings, published in English were included. An inductive content analysis was used to analyse the results of the included studies (n = 53). The most frequently used investigation method was the questionnaire survey seeking the opinions of older people, informal caregivers or healthcare professionals. The unmet care needs identified using the World Health Organization classification were categorized as physical, psychosocial and spiritual, and mostly described individuals’ experiences, though some discussed unmet care needs at an organizational level. The ethical issues raised related to the clinical prioritization of tasks associated with failing to carry out nursing care activities needed. The unmet care needs highlighted in this review are related to poor patient outcomes. The needs of institutionalized older patients remain under-diagnosed and thus, untreated. Negative care outcomes generate a range of serious practical issues for older people in care institutions, which, in turn, raises ethical issues that need to be addressed. Unmet care needs may lead to marginalization, discrimination and inequality in care and service delivery. Further studies are required about patients’ expectations when they are admitted to hospital settings, or training of nurses in terms of understanding the complex needs of older persons. (shrink)

Adults and infants display a robust ability to perceive the unity of a center-occluded object when the visible ends of the object undergo common motion (e.g. Kellman, P.J., Spelke, E.S., 1983. Perception of partly occluded objects in infancy. Cognitive Psychology 15, 483±524). Ecologically oriented accounts of this ability focus on the primacy of motion in the perception of segregated objects, but Gestalt theory suggests a broader possibility: observers may perceive object unity by detecting patterns of synchronous change, of which common (...) motion is a special case. We investigated this possibility with observations of adults and 4-month-old infants. Participants viewed a center-occluded object whose visible surfaces were either misaligned or aligned, stationary or moving, and unchanging or synchronously changing in color or bright- ness in various temporal patterns (e.g. ¯ashing). Both alignment and common motion con- tributed to adults' perception of object unity, but synchronous color changes did not. For infants, motion was an important determinant of object unity, but other synchronous changes and edge alignment were not. When a stationary object with aligned edges underwent syn- chronous changes in color or brightness, infants showed high levels of attention to the object, but their perception of its unity appeared to be indeterminate. An inherent preference for fast over slow ¯ash rates, and a novelty preference elicited by a change in rate, both indicated that infants detected the synchronous changes, although they failed to use them as information for object unity. Resumo O fundamentalismo é um fenômeno relativamente recente, pelo menos como posição articulada e autoconsciente. O presente artigo apresenta, de início, uma reflexão sobre o surgimento do termo fundamentalismo, em breve resgate histórico. A seguir, identifica e analisa as características principais dessa atitude, tanto na sua configuração psicológica (subjetivismo fechado), como na sua teoria epistemológica implícita (fideísmo radical, fé ou submissão a uma autoridade religiosa como fonte exclusiva ou predominante de certeza epistemológica), na sua hermenêutica (liberalismo na interpretação de escrituras) (...) e na sua maneira de priorizar um ativismo radical, na perspectiva pragmática (tendência a medidas radicais, à militância e até ao terrorismo no prosseguimento efetivo dos seus fins). Aplicando essa análise, mostra que os debates atuais entre cristãos e "neoateus" parecem frequentemente fundamentalistas, mas não apenas do lado religioso da disputa. Talvez o nome de fundamentalista possa ser reivindicado por alguns que ficariam bem surpresos pela nova titulação. A última parte do artigo discute a religião "usada" e "abusada". The present article begins by reflecting on the origin of the term fundamentalism in a brief historical review. Then the principal characteristics of this attitude are identified and analyzed, both in its psychological configuration (a closed subjectivity), as well as in its implicit epistemological theory (radical fideism, faith or submission to a religiou authority as exclusive or predominant source of epistemological certitude), its hermeneutics (literalism in the interpretation of scriptures) and its manner of prioritizing radical activisim in its pragmatic perspective (tendency to radical means, to militancy and even terrorism in the effective persecution of its ends). Applying this analysis, current debates between Christians and "neo-atheists" appear frequently fundamentalist, but not only on the religious side of the dispute. Perhaps the name fundamentalist can be claimed even by some who would be quite surprised by the new christening. The last part of the article discusses "used" and "abused" religion. Two Kinds of Vagueness When signing up for insurance benefits at my job, I was asked, “Do you have children, and if so are they young enough to be included on your policy?” I replied that I had two children, both of whom were over 21. The benefits officer responded, “That’s too vague. In some circumstances children of covered employees are eligible for benefits up to their 26th birthday. I need their ages to determine whether they can be included on (...) your policy.” She was right; my remark was too vague. The information it provided was insufficiently specific to advance our common conversational purpose. However, it was not vague, or at any rate not too vague, in the sense in which philosophical logicians and philosophers of language study vagueness. Vague predicates – like ‘old’, ‘bald’, ‘rich’, and ‘red’ – are those for which there are “borderline cases” separating things to which the predicate clearly applies from those to which it clearly does not. When o is a borderline case for a predicate P, there is, in some sense, “no saying” whether or not the proposition expressed by  That/he/she/it is P (said demonstrating o) is true. According to some theories of vagueness, the proposition is undefined for truth, or untruth, and so can’t correctly be characterized either way. According to others, it is true or false -- even though it is impossible, in principle, to know which. On still other theories, it is only partially true (or true to some degree). For present purposes we needn’t worry about which of these theories is correct, or which is most illuminating in discussions of the law. The present point is simpler. The problem with my remark to the benefits officer – the sense in which it was too vague – is not a matter of its susceptibility to borderline cases. What I stated, on December 10, 2009, was that my two children were both over 21 years old then. That statement is true if and only if both were born on or before.... (shrink)

In GC I.1 Aristotle criticizes the monists and pluralists for accepting positions that eliminate either generation or alteration, and in GC I.4 he defends the existence of both. Thus, he must believe that his account is immune to those objections he raises against his predecessors, but it is difficult to reconstruct these objections, and so difficult to discern how Aristotle distinguishes his own account from theirs. In this paper, I propose a new reconstruction of these objections, and I show how (...) Aristotle’s own account is immune to them so reconstructed. On my interpretation, Aristotle argues that neither the monists nor the pluralists can explain the generation of a substance. The monists cannot explain how an ultimate subject of predication–one mark of substance–is generated. The pluralists cannot explain how a being that can alter–another mark of substance–is generated. I subsequently show how Aristotle’s own account in GC I.4 sufficiently diverges from his predecessors to allow something that is both generable and alterable. (shrink)

Paul Ricoeur’s narrative and critical hermeneutics provides the conceptual resources to accommodate Barthes’ and similar critiques of subjectivity whilepositing a revised form of authorial intention similar to the “postulated author” of Alexander Nehamas and the “creative process” of Richard Wollheim. Though influenced by Barthian critiques, all three thinkers retain a notion of authorial intent*one distinct from the intentions of the historical author*necessary for the understanding of meaning in the philosophy of literature. Yet, the implications of this allow us to reverse (...) the Ricoeurian insight of understanding human action as a text, and show how human action provides clarification on authorial intention. Using Ricoeur and Nehamas, I would like to revisit the issue of authorialintention in order to show the insights this offers for hermeneutics and philosophy of literature. If authorial intention is properly reestablished as distinct from theintentions of the historical writer, we can turn to a minimalistic version of the analytic philosophy of action based on Ricoeur and Carlos Moya to provide auseful heuristic conceptual framework to look at both authorial and ‘readerly’ intention.In employing the philosophy of action, this conceptual framework will be used instrumentally in aid of interpreting the text and providing further analysisand conceptual clarity to the notion of authorial intention. Further, analyzing ‘writerly’ and ‘readerly’ intention as action*communicative action*sidesteps thephilosophical issue of the ‘artistic process’ which had absorbed the attention of aesthetics since Plato, without sidestepping the issues of authorial intention andreaderly intention.1 I will argue that in using variants of the philosophy of action, we can ignore psychological issues and instead focus on the broader issues ofmeaning-expression at the heart of both readerly and writerly intention. I will then demonstrate this heuristic framework using Hölderlin’s epic poetry and Blanchot’s The Writing of the Disaster. (shrink)

In his celebrated_ Essay on Population_, Thomas Malthus raised the puzzle of why a benevolent Creator would permit material scarcity in human existence. Albino Barrera revisits this question using Thomas Aquinas’s metaphysics of participation and Sacred Scripture’s invitation to covenant fidelity and kingdom discipleship as analytical lenses with which to examine the seeming incongruity of scarcity in God’s providence. Barrera concludes that scarcity turns out to be a signal opportunity for economic agency to receive, internalize, and communicate God’s goodness and (...) righteousness within the human community. Written for theologians, philosophers, social scientists, and policymakers interested in the theological and philosophical foundations of economics, this study argues that precarious, subsistence living is not an immutable law of nature. Rather, such a chronic, dismal condition reflects personal and collective moral failure. The aim of the article is to concretize the concept of “globalization”, and also through the analysis of tectonic shifts in the world sociological system, to represent the main socio-political, cultural and civilizational dimensions of this concept. Research objectives - in the context of the stated goal, the essence of the social dynamics of a globalizing world is revealed. Research Methodology. The methodology is based on an integrated approach, due to its interdisciplinary nature. The result of the study. Sociodynamics is revealed as the process of its deployment in time and space in conjunction with the social organization of social organization, as well as with social changes and upheavals affecting the progressive course of its development. The contradictory nature of globalization has been proved, its brilliance and poverty are revealed with specific examples. The whole range of problems of globalization as a multidimensional phenomenon is actualized. The reasons that prevented the implementation of the concept of Western ideologists about building a unipolar world and the creation of a single governing body under the auspices of the United States are revealed. Sociodynamics of the global world, in the context of the goal set, is reflected through the prism of the financial and economic dimension; through the formation of frontiers, fraught with the charge of aggravation, instability, risks, dynamic chaos. Conclusions. The mechanisms of regulation of the emerging chaos in social relations - threats, sanctions, crisis fluctuations, the use of “soft power”, conflicts, etc. are substantiated. This article provides a critical appraisal of the case for healthcare being rationed away from older patients to those who are younger. After sketching a metaphysics of elderliness and reviewing clinical and economic cases for healthcare rationing, the article looks in depth at the most challenging case for age rationing known as the ‘fair innings’ case. This article rejects that case and makes an alternative case that fairness actually dictates against age rationing in favour of allocation on the basis of (...) need. In 'Physics' I.7, Aristotle claims that plants and animals are generated from sperma. Since most understood sperma to be an ovum, this claim threatens to undermine the standard view that, for Aristotle, the matter natural beings are generated from persists through their generation. By focusing on Aristotle’s discussion of sperma in the first book of the 'Generation of Animals', I show that, for Aristotle, sperma in the female is surplus blood collected in the uterus and not an ovum.
